Commonly several months from petition to close. The timeline depends on when letters are issued, whether the administrator has full IAEA authority, and whether the sale requires court confirmation.
Can you sell a house before probate is complete?
A sale can usually proceed once the personal representative has authority, though it may still require court confirmation depending on the authority granted. The estate's attorney determines this.
Who sets the price in a probate sale?
A court-appointed probate referee appraises the property. The list price is set with that appraisal in mind, alongside current market evidence.
What is an overbid?
At a court-confirmation hearing, other buyers may bid above the accepted offer under a formula set by the court. Marketing the property properly beforehand is what protects the estate's outcome.
